Terms of Service

These Terms of Service ("Terms") govern your use of the ABSplitLab application ("Service"), operated by ABSplitLab ("we", "us", "our"). By installing or using ABSplitLab, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing the ABSplitLab app from the Shopify App Store, accessing the ABSplitLab dashboard, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must uninstall the app and discontinue use immediately.

2. Description of Service

ABSplitLab is a Shopify application that enables merchants to run A/B tests (split tests) on their online stores. The Service includes:

  • Creating and managing A/B test experiments on product pages and other store sections.
  • Testing variations of product images, titles, descriptions, prices, button colors, checkout elements, and more.
  • Tracking anonymous visitor behavior (page views, add-to-cart events, purchases) to measure variant performance.
  • Statistical analysis of test results, including Bayesian probability calculations and confidence intervals.
  • AI-powered test suggestions (available on select plans).
  • Injecting a lightweight JavaScript snippet (under 2KB gzipped) into your Shopify storefront to handle variant assignment and event tracking.

3. Account Registration

ABSplitLab uses Shopify OAuth for authentication. By installing the app, you authorize us to access certain Shopify store data as required by the app's functionality, including product information, theme data, and order data (for revenue attribution). You are responsible for maintaining the security of your Shopify account. You must be the store owner or have authorization from the store owner to install and use ABSplitLab.

4. Billing and Plans

ABSplitLab offers the following subscription plans:

  • Free: 1 active experiment, 1,000 visitors/month, 4 basic test types.
  • Starter ($19/month): 5 active experiments, 50,000 visitors/month, 7 test types, basic reports.
  • Growth ($29/month): Unlimited experiments, 200,000 visitors/month, 11 test types, Bayesian statistics, device analytics.
  • Scale ($49/month): Unlimited experiments, unlimited visitors, all 13 test types, AI suggestions, advanced audience segmentation.
  • Enterprise ($199/month): Everything in Scale plus dedicated support, custom integrations, and SLA guarantees.

All paid plans are billed through Shopify's billing system. Charges appear on your Shopify invoice. You may upgrade, downgrade, or cancel your plan at any time. Cancellations take effect at the end of the current billing cycle. No refunds are provided for partial billing periods.

We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

5. Acceptable Use

You agree to use ABSplitLab only for lawful purposes and in compliance with Shopify's Terms of Service and Acceptable Use Policy. You may not:

  • Use the Service to conduct deceptive or misleading tests that violate consumer protection laws.
  • Run price tests that display a higher price at checkout than the price shown to the visitor during the test (bait-and-switch).
  • Attempt to reverse-engineer, decompile, or extract the source code of the ABSplitLab snippet or application.
  • Use the Service to collect or store personal data of your store visitors beyond what ABSplitLab explicitly provides.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Exceed the visitor limits of your plan through artificial means or bot traffic.
  • Resell, sublicense, or redistribute the Service to third parties.

6. Intellectual Property

The ABSplitLab application, including its code, design, documentation, branding, and all related materials, is the intellectual property of ABSplitLab and is protected by applicable copyright and trademark laws.

You retain full ownership of your store content, product data, and experiment configurations. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the A/B testing service.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ABSplitLab is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee that test results will lead to increased revenue or conversions.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not responsible for revenue loss resulting from experiments running on your store, including price tests. You are responsible for monitoring your experiments and their impact on your business.

8. Indemnification

You agree to indemnify and hold harmless ABSplitLab, its officers, directors, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

9. Termination

You may terminate your use of ABSplitLab at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access to the Service if:

  • You violate these Terms or Shopify's Terms of Service.
  • Your use of the Service poses a security risk or may cause harm to other users.
  • We are required to do so by law.

Upon termination, all active experiments will be stopped, and the ABSplitLab snippet will be removed from your store. Your data will be retained for 30 days to allow for reactivation, after which it will be permanently deleted.

10. Data Handling

Our collection and use of data is governed by our Privacy Policy. By using the Service, you acknowledge and agree to our data practices as described therein. Key points:

  • We do not collect personal information from your store visitors.
  • We use anonymous session IDs and aggregated metrics only.
  • Your experiment data is stored securely and encrypted at rest.
  • We will never sell your data to third parties.

11. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or unforeseen technical issues. We will make reasonable efforts to notify you of planned downtime in advance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Paris, France.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and notify you via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
